DATA PRIVACY STATEMENT

Use of our website is generally possible without the input of personal data. Where the input of personal data (for example name, address or e-mail addresses) is requested on our website, this input is always on a voluntary basis as far as possible. These data are not passed on to third parties without your express consent.

We should point out that data transmission on the Internet (e.g. during communication by e-mail) can have security flaws. Absolute protection of the data against access by third parties is not possible. We employ the latest encryption technologies to minimise the risk of access by third parties.

We hereby expressly object to the use of the contact data published within the framework of our obligation to provide a masthead for the purpose of sending advertising and information materials not explicitly requested. The website operators expressly reserve the right to take legal action if we are sent unsolicited advertising information, for example, in the form of spam mails.

When you contact us (e.g. via the contact form, by e-mail, telephone or via the social media), the user data are processed in accordance with Art. 6 (1) lit. b) GDPR for the purposes of dealing with the contact. The user data can be stored in a customer relationship management system ("CRM system") or comparable enquiry organisation system. We delete the data when they are no longer required. Declaration of consent under data protection law for use of the contact form

The personal data that you provide to us within the context of a contact enquiry are used only for the purposes of answering your enquiry or request for contact and for the associated technical administration. We do not use the double opt-in procedure in our contact forms in order to enable a quick contact, as a quick response is necessary in view of the services we provide. The data you provide to us are stored in our systems for 4 weeks before they are deleted.

DECLARATION OF CONSENT UNDER DATA PROTECTION LAW FOR USE OF EVENT REGISTRATIONS

The personal data that you provide to us within the context of registration for an event are used only for the purposes of confirming your registration or your contact for this purpose and for the associated technical administration. We do not use the double opt-in procedure in our registration forms in order to enable quick processing of your registration. The personal data stored by us are deleted as soon as they are no longer required for their intended purpose, and their deletion does not contravene statutory retention periods.

DECLARATION OF CONSENT UNDER DATA PROTECTION LAW FOR USE OF THE ONLINE QUICK APPLICATION FORM

With your online application on our Careers page, you voluntarily provide us with personal data. With this online application, you document your interest in employment with the ISOTEC Group and declare at the same time your consent to us storing and processing the data provided for this purpose in our applicant management system. You are personally responsible for the correctness of these data.

We do not provide your personal data to third parties in any form whatever unless you have given your consent or if we are required to do so by an official injunction.

The legal basis for this is Art. 6 (1) page 1 lit. b GDPR.

Intended use

We will use the personal data provided by you only for the purpose of a personnel recruitment process.

We will also use them for other purposes for which you have given your consent, provided that no legal requirements exist to the contrary.

Storage

Your personal data will be stored for as long as is necessary to carry out the process requested by you (personnel recruitment process), provided that no legal requirements exist to the contrary. If we conclude an employment contract with an applicant, the data provided will be stored for the purposes of handling of the employment relationship in observance of the statutory regulations. If no an employment contract is concluded with an applicant, the application documents will be automatically deleted six months after notification of the rejection as long as the deletion does not infringe any other legitimate interests of the controller responsible for the processing. Other legitimate interests in this context could be, for example, use as evidence in legal proceedings in accordance with the German General Equal Treatment Act (AGG).

Data protection of applications and in the recruitment process

We collect and process the personal data of applicants for the purposes of handling of the recruitment process. The data can also be processed electronically. This is the case, in particular, if an applicant submits such application documents to us electronically, for example by e-mail or via a web form on the Internet website. The legal basis for this is Art. 6 (1) page 1 lit. b GDPR.

If we conclude an employment contract with an applicant, the data provided will be stored for the purposes of management of the employment relationship in observance of the statutory regulations. If no an employment contract is concluded with an applicant, the application documents will be automatically deleted six months after notification of the rejection as long as the deletion does not infringe any other legitimate interests of the controller responsible for the processing. In our live chat you have the opportunity to contact our Careers staff directly and to put your career-related questions to them in the form of a real-time chat. As with the situation outside the virtual world, there are certain general social manners that apply also to discussions in the chat. We look forward to open, polite and respectful exchanges during the online chat. We reserve the right to terminate chats in which offensive language is used and to block users in the case of particularly severe violations.

This website uses Zendesk Chat, a live chat software from Zendesk, Inc. a U.S., 1019 Market Street, San Francisco, CA 94103. Zendesk uses i.a. “cookies”, small text files that are stored on your computer to permit a personal exchange with you in the form of a real-time chat on the website, and which enable the website visitor’s Internet browser to be recognised in order to be able to distinguish between the individual users of the chat function on our Internet website. Your data transmitted during the live chat are stored on servers of Zendesk, Inc. in Dublin, Ireland. With the use of the live chat, you consent to this transmission. To be able to use the chat, you have to enter your name and your e-mail address. Furthermore, we store your IP address and the chat protocols for 4 weeks. If the information collected in this way allows a personal identification, it is processed in accordance with Art. 6 (1) lit. f GDPR on the basis of our legitimate interest in effective applicant management.

Data privacy statement for the use of the Newsletter service

The following information explains the contents of our newsletter and the registration, dispatch and statistical evaluation procedures and your rights of objection. With your subscription to our newsletter, you declare your consent to the receipt of the newsletter and to the procedures described.

Content of the newsletter: We send newsletter, e-mails and other electronic notifications with advertising information (hereinafter referred to as “newsletter”) only with the consent of the recipient or with statutory authorisation. If the contents of the newsletter are described in concrete terms during the subscription to our newsletter, then these are binding for the users’ consent. Our newsletter otherwise contains information about our services and our company.

Double opt-in and logging: Subscription to our newsletter follows the double opt-in procedure. This means that after your subscription, you receive an e-mail from us in which you are requested to confirm your subscription. This confirmation is necessary so that no-one can subscribe using the e-mail addresses of other persons. The subscriptions to the newsletter are logged in order to be able to register the subscription process in accordance with the legal requirements. This includes the storage of the time of subscription and confirmation, and the IP address. The changes to your data stored with the dispatch service provider are also logged.

Subscription data: In order to subscribe to the newsletter, we need your e-mail address, your gender and your first and family names to enable a personal address in the newsletter.

Germany: The dispatch of the newsletter and the associated performance assessment are based on the consent of the addressees in accordance with Art. 6 (1) lit. a, Art. 7 GDPR in conjunction with § 7 (2) No. 3 German Fair Trade Practices Act (UWG) or on the basis of the statutory consent in accordance with § 7 (3) 3 UWG.

The logging of the subscription procedure is performed on the basis of our legitimate interests in accordance with Art. 6 (1) lit. f GDPR. Our interest is directed to the use of a user-friendly and secure newsletter system that both serves our business interests and meets the expectations of the users, as well as enabling us to provide evidence of consent.

Unsubscribe/revocation You can unsubscribe from our newsletter, i.e. revoke your consents, at any time. A link for unsubscribing from the newsletter can be found at the end of every newsletter. We can store the unsubscribed e-mail addresses for up to three years on the basis of our legitimate interests before we delete them for the purpose of the newsletter dispatch in order to be able to furnish proof of consent having been given. The processing of these data is limited to the purpose of defence against possible claims. An individual application for deletion is possible at any time as long as confirmation of the previous consent is given at the same time.

The dispatch service provider can use the data of the addressees in pseudonymous form, i.e. without identification of a user, to improve or optimise its own services, e.g. for technical optimisation of the dispatch and the presentation of the newsletters, or for statistical purposes. The dispatch service provider does not, however, use the data on our newsletter subscribers to contact them directly or to pass the data on to third parties.

If you leave comments in the blog or other contributions on our website, these will be saved together with your name, e-mail address and IP address for 4 weeks on the basis of our legitimate interests in accordance with Art. 6 (1) lit. f. In order to protect your data, we employ the “Shariff” solution for the implementation. Data privacy statement for the use of Facebook plug-ins (“Like” button)

On the basis of our legitimate interests (i.e. interest in analysis, optimisation and cost-efficient operation of our online offering as defined in Art. 6 (1) lit. f. GDPR), we use social plug-ins ("plug-ins") of the social network facebook.com that is operated by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"). If a user calls up a function of this online offering that contains such a plug-in, the user’s device sets up a direct link to the Facebook servers. The content of the plug-in is transmitted by Facebook directly to the user’s device and is integrated into the online offering. Use profiles on the users may thereby be created from the processed data. We therefore have no influence on the scope of the data that Facebook collects using this plug-in and can therefore only inform users in line with our level of knowledge.

The incorporation of the plug-ins provides Facebook with the information that a user has called up the corresponding page of the online offering. Every data subject has the right to information in accordance with Article 15 GDPR, the right to rectification in accordance with Article 16 GDPRO, the right to erasure in accordance with Article 17 GDPRO, the right to restriction of processing in accordance with Article 18 GDPR, the right to object under Article 21 GDPR and the right to data portability under Article 20 GDPR. (1) Wir setzen das Analysetool Facebook-Pixel von der Facebook Inc., 1601 S California Ave, Palo Alto, California 94304, USA. Facebook-Pixel ist ein Analysetool, mit dem man die Effektivität von Werbung messen kann. Es wird i.d.R. dazu eingesetzt, Handlungen von Menschen auf einer Webseite zu verstehen und nachzuvollziehen. Man implementiert das Facebook-Pixel auf einer Internetseite, indem man den Pixel-Code im Header der Internetseite platziert. Wenn jemand dann die Internetseite besucht und eine Handlung ausführt (beispielsweise einen Kauf abschließt), wird das Facebook-Pixel ausgelöst und die Handlung wird gemeldet. Auf diese Weise erfährt man, wenn ein Kunde eine Handlung vornimmt und kann dies auswerten. Es gibt zudem die Möglichkeit des erweiterten Abgleichs, die wir ebenfalls nutzen und die ebenfalls von Ihrer Einwilligung umfasst ist. Das Facebook-Pixel ermöglicht es, Kundendaten wie z. B. Vorname, Nachname, E-Mail-Adresse, usw. an Facebook zu übermitteln und mit bestehenden Tracking-Daten anzureichern. So ist es möglich, auch Daten von Nicht-Facebook-Nutzern zu erheben oder Nutzer zu erfassen, die während des Besuchs einer Webseite nicht bei Facebook eingeloggt sind. Wir setzen das tool Facebook Custom Audiences ein

(1) Weiterhin verwendet die Website die Remarketing-Funktion „Custom Audiences“ der Facebook Inc. 1601 S California Ave, Palo Alto, California 94304, USA. Was geschieht, wenn Sie mit uns über WhatsApp kommunizieren? Inwieweit willigen Sie darin ein? Welche Risiken bestehen dabei?

(1) Über die Betätigung der Schaltfläche „WhatsApp“ haben Sie die Möglichkeit, über die mobile Applikation WhatsApp mit uns zu kommunizieren. Ferner weisen wir Sie darauf hin, dass der Anbieter im EU-Privacy-Shield-Framework gelistet ist, vgl. www.privacyshield.gov/participant.

(2) Hierbei bestehen erhebliche Risiken, die wir wie folgt beschreiben:

1. Wir gehen nicht davon aus, dass die vertraglichen Vereinbarungen mit dem Anbieter den Vorgaben des Artikel 28 DSGVO genügen. Daher bestehen für Sie, wenn Sie per WhatsApp mit uns kommunizieren schon deshalb erhebliche Risiken, weil wir nicht sicherstellen können, 

a. dass der Anbieter Ihre Daten nur gemäß unseren Weisungen handelt,

b. dass der Anbieter hinreichende technische und organisatorische Maßnahmen zum Schutz Ihrer Daten ergriffen hat,

c. dass der Anbieter uns und Sie unterstützen wird unsere oder Ihre Rechte zu wahren,

d. dass wir problemlos die Löschung Ihrer Daten bewirken kann,

e. dass der Anbieter nicht auf Ihre Daten, insbesondere die Kommunikationsdaten zugreift,

f. dass der Anbieter Ihre Daten nicht an Dritte übermittelt, einschließlich etwaiger Schwestergesellschaften, Werbekunden, Ermittlungsbehörden.

2. Wir gehen nicht davon aus, dass am Sitz des Anbieters (USA) dauerhaft ein angemessenes Datenschutzniveau gewährleistet ist. Das bedeutet, dass die Rechtsschutzgarantien, die Sie insbesondere in der Europäischen Union gewöhnt sind, hier nicht oder nur unzureichend gewährleistet sind. Das bedeutet, dass Sie im Fall, dass Ihr Recht auf informationelle Selbstbestimmung oder andere Ihrer Rechte verletzt werden, etwaige Schäden, die dadurch entstehen, nicht oder nur teilweise ersetzt werden können. Insbesondere können wir nicht für etwaige Rechtsverletzungen des Anbieters einstehen.

3. Die Risiken werden auch dadurch erhöht, dass der Anbieter seit 2014 Teil der Facebook Inc. ist. Hier besteht die Möglichkeit, dass der Anbieter und Facebook Daten austauschen, um diese auszuwerten und insbesondere, um Sie werblich anzusprechen und/oder Ihre Daten zu veräußern. Wir betonen nochmals, hierauf keinen Einfluss zu haben.

(3) Rechtsgrundlage für die Kommunikation ist Ihre Einwilligung, die Sie durch Betätigung des Klickfeldes „Senden“ neben dem Hinweis „Mit Klicken auf ‚Senden‘ willigen Sie ein, mit uns über WhatsApp zu kommunizieren, wobei Sie wissen, dass insoweit rechtliche, technische und geographische Risiken bestehen, wie in der Datenschuzterklärung beschrieben.“ erteilen. Ihre Einwilligung umfasst, dass

1. wir über diesen Anbieter mit Ihnen kommunizieren,

2. wir insoweit an diesen Anbieter auch Ihre Daten übermitteln, da hier gerade keine Beauftragung i.S.v. Artikel 28 DSGVO gegeben ist,

3. die Kommunikation über diesen Anbieter sehr riskant ist, wie unter Absatz 2 beschrieben,

4. der Anbieter Ihre Daten außerhalb der Europäischen Union verarbeitet, was auch dann gilt, wenn es keinen Angemessenheitsbeschluss der Europäischen Kommission hinsichtlich des Sitzlandes Anbieters mehr gibt, etwa weil der Europäisches Gerichtshof einen solchen Angemessenheitsbeschluss für unvereinbar mit europäischem Recht hält.

(4) Der Datenverarbeitung steht auch nicht entgegen, dass sie außerhalb der Europäischen Union stattfindet. Denn der Anbieter ist im Privacy-Shield-Framework gelistet, wodurch die Verarbeitung außerhalb der Europäischen gemäß Artikel 45 Absätze 1 und 9 DSGVO i.V.m. Artikel 3 Absatz 2 DSGVO i.V.m. dem Durchführungsbeschluss 2016/1250 der Kommission vom 12. Juli 2016 zum Az. C(2016) 4176 erlaubt ist. Für den Fall, dass der vorgenannte Beschluss außer Kraft treten sollte oder anderweitig nicht mehr gelten sollte, wäre die Verarbeitung außerhalb der Europäischen Union durch Ihre oben erläuterte Einwilligung gemäß Artikel 49 Absatz 1 lit. a DSGVO gerechtfertigt ist.

(5) Der Datenverarbeitung steht auch nicht entgegen, dass wir den Anbieter nicht gemäß Artikel 28 DSGVO beauftragt haben, was insbesondere zur Folge hat, dass wir einerseits nicht überprüft haben, ob er hinreichende technische und organisatorische Schutzmaßnahmen ergreift und andererseits nicht sicherstellen können, dass der Anbieter unseren Weisungen folgt. Denn die mit der Nutzung dieser mobilen Applikation einhergehende Datenübermittlung ist durch Ihre Einwilligung, wie in Absatz 3 beschrieben, ausdrücklich gerechtfertigt.

(6) Wir speichern Ihre Daten bis zum Ende der gesetzlichen Aufbewahrungsfrist, die in der Regel sechs Jahre beträgt. Die Aufbewahrungsfrist beginnt mit dem Schluss des Kalenderjahrs, in dem die Daten erhoben wurden. Sollte eine solche nicht bestehen, speichern wir die Daten bis zum Widerruf Ihrer Einwilligung. Die Speicherungsdauer beim Anbieter der mobilen Applikation können wir nicht beeinflussen.
